Terms of Service

By booking an appointment with Show Kingston, you agree to the terms and conditions of service listed below.

These Terms of Service govern the use of real estate photography and media services provided by Show Kingston (“the Company”) to its clients (“the Clients”). By accessing and using the services provided by the Company, the Clients agree to comply with these Terms of Service.

Definitions

  • “Company” refers to Show Kingston
  • “Client” refers to any individual or entity using the Company’s services
  • “Services” refer to the real estate photography, media, and related services provided by the Company

Service Description
The Company offers professional real estate photography and media services, including property photography, virtual tours, floor plans, image editing, drone services, and other related services as agreed upon.

Property Preparation and Client Responsibilities

Clients must:

  • Ensure the property is clean, staged, and ready for photography, as per the Presenting Your Property checklist.
  • Meet the photographer at the scheduled appointment time or provide the necessary information to access the property. As a courtesy, the photographer will wait for up to 10 minutes to gain access.
  • If the photographer is unable to gain access, the Client will be subject to an $80 cancellation fee as well as any applicable driving charges.
  • Confirm that occupants are aware and comfortable with the photography session.
  • Inform all tenants/occupants of the scheduled shoot and ensure unimpeded access to all areas. Inform the photographer about any pets and ensure they are secured.
  • Pay a $45/hour waiting fee if the property is not ready at the scheduled time, and the photographer’s schedule can accommodate this delay.

Cancellation and Rescheduling
Appointments can be cancelled or rescheduled free of charge up to 48 hours prior to the scheduled appointment time. (This notice allows us to offer this time slot to another client.)

For appointments that are cancelled or rescheduled within 48 hours of their scheduled appointment time, the Client will be subject to a $40 cancellation fee. If the photographer arrives at the property and is unable to proceed with their work at the scheduled appointment time, the Client will be subject to an $80 cancellation fee as well as any applicable driving charges.

Weather
Our policy is to proceed with scheduled appointments regardless of weather conditions. We will prioritize interior work and will return to perform exterior work at no additional cost once the weather improves.

For properties located outside the City of Kingston, we reserve the right to reschedule appointments due to unfavourable weather conditions.

Client Requests
Clients are encouraged to conduct a walkthrough of the property with the photographer to communicate their preferences and any specific requests regarding the services to be provided. If a walkthrough does not occur, the photographer will rely on their professional judgment to proceed.

Resident Vacancy
All occupants should either plan to leave the property or stay in areas where they are out of sight during the photoshoot. (Rooms overlap in the photos, people can cause shadows and reflections, and there is a risk to the equipment that the photographer will be setting up throughout the property.)

Photographer’s Scope of Work
Photographers will perform only the tasks necessary to deliver the booked services. Any additional services requested will incur extra fees.

Pricing and Square Footage Adjustment
Pricing is based on the property’s square footage and the services requested.

Any discrepancy between the actual square footage of the property (as determined by the floor plans and measurements taken) and the booked property size will be reflected in the final invoice, with pricing adjusted accordingly.

Payment and Delivery
When using our online booking system (coming soon), payment is made at the time of booking.

When a booking is made offline, the Client will receive an invoice via email after the photoshoot. Payment can be made through e-transfer or by credit card using a secure payment platform. Completed work will be delivered to the Client upon receipt of payment unless a different payment schedule has been agreed upon.

Photographs and other media will be delivered to the Client by the end of the next business day. Virtual Tours and Floor Plans will be delivered as soon as iGUIDE completes the drafting, typically within 24 hours of file submission, unless it falls on a statutory holiday.

Usage Rights and License
The Company retains full copyright ownership of all media produced.

The Client is granted a non-exclusive license to use the media provided solely for real estate marketing purposes.

The Client must not resell, sublicense, or distribute content without written permission.

No Refund Policy
Refunds will not be issued.

Reviewing Portfolio and Setting Expectations
Clients should review the Company’s portfolio to understand the style and quality of work produced by our photographers and clearly communicate their expectations before the shoot to ensure alignment.

To avoid dissatisfaction, Clients should ensure the property is prepared and follow the recommendations in the Presenting Your Property checklist.

Standard Process and Additional Charges
The Company has a standardized process for shooting and editing. Additional requests may incur extra charges.

Media Storage and File Availability
All media files are stored for a period of one month. It is the Client’s responsibility to download files within this timeframe; after this period, they may be removed without notice.
